Breaking! Appeals Court Knocks Biden Rule Allowing Mail Order Abortions, U. S. Supreme Court to Take Up Issue

Austin, TX. – May 4, 2026: On Friday, the 5th Circuit Court of Appeals said that the FDA Biden rule allowing unbridled access to the abortion pill undermined Louisiana’s strong pro-life laws. The Court also found that allowing women to access dangerous abortion drugs financially harmed the state because the state Medicaid program had to cover numerous extreme health complications women faced when ingesting the abortion drugs. This ruling was a victory for the pro-life movement as Texas and many other states have enacted laws that outlaw the mailing and distribution of abortions drugs. However, this morning the U. S. Supreme Court stayed an emergency appeal for the chemical abortion pill, allowing access to the abortion drugs until the Court takes up the issue. 

Mary Elizabeth Castle, Director of Government Relations for Texas Values, said:

“I am grateful for the 5th Circuit decision that reveals the truth we know about dangerous abortion drugs. Abortion drugs often end the lives of two people and not just one. 1 in 25 women will go to the hospital if they ingest these abortion pills. We must protect women and babies from the deadly dosage, and the Wild West regulations from the Biden era should end.” 

In 2021, Texas passed a law (Senate Bill 4) to stop mail order abortions and require that important safety regulations be followed to stop complications from abortion drugs. Recently, the Texas Legislature passed House Bill 7 that further restricts access to abortion pills and allows for a private cause of action to be taken against someone distributing abortion pills. These laws are still in effect. Texas Values led the efforts on both of these laws including the Texas Heartbeat Law, which has saved approximately 265,000 lives. 

In 2024, the Texas Values law and policy team was present at the U.S. Supreme Court oral arguments for FDA v. Alliance for Hippocratic Medicine, which addressed a Texas federal judge decision to block the FDA’s loosening of restrictions on access to chemical abortion pills.
