Federal Court Dumps Texas Law Protecting Human Dignity of Aborted Children

AUSTIN – Federal Judge David A. Ezra of the United States District Court for the Western District of Texas struck down a state law in the Whole Woman’s Health v. Smith case, a lawsuit challenging measures that recognize the human dignity of aborted children. Whole Woman’s Health (an abortion provider) is suing the state of Texas over state rules and state law (SB 8) that ensure children who have been aborted are buried or cremated, rather than barbarically disposed of in a sewer or landfill.

Texas Values testified and strongly supported the state rules and SB 8.

Jonathan Saenz, attorney for Texas Values, stated:

“This is the type of activist judge we will be seeing less of in Texas as President Trump fills court vacancies with judges who respect the Constitution and the rule of law. We applaud Attorney General Ken Paxton’s team for their great work defending Texas law and the dignity of aborted children. The bodies of aborted babies deserve to be treated with respect and no longer callously treated like medical waste and disposed of by ‘grinding and discharging into a sanitary sewer system.’ This is not the end of this case by a long shot.”
