Breaking! Supreme Court Will Decide if Biden Administration Can Sex-change Kids, Constitutionality of Texas’ SB 14 Argued

Austin, TX – June 26, 2024: This week, the United States Supreme Court agreed to hear a case on the Biden Administration’s challenge to state laws that protect children from harmful sex-change operations and mutilation. The case United States v. Skrimetti comes from the 6th circuit Court of Appeals. The appellate court ruled in Skrimetti that the state of Tennessee could enforce its law that protects kids from gender modification surgeries and cross-sex hormone prescriptions. Tennessee, along with Texas, is among the 23 states in the country that have passed laws outlawing harmful child gender modification. Texas passed and signed into law , SB 14 the Stop Child Gender Modification Law, in 2023. Texas Values was the leading law and policy organization that advocated for the passage of SB 14. Texas Values also filed an amicus brief in support of the law when it was challenged by American Civil Liberties Union (ACLU) in a lawsuit at the Texas Supreme Court. The Biden Administration’s lawsuit against Tennessee’s law to protect children from gender modification claims that such laws are unconstitutional under the Equal Protection Clause of the 14th amendment.

Texas Values Director of Policy, Jonathan Covey said:

“No child deserves a false sense of hope from the unscientific idea that they are not really the sex they were born. We’re thrilled that the U.S. Supreme Court will finally have the opportunity to ensure the equal protection of all children from harmful and irreversible gender treatments. Let’s finish this fight for our kids!”

The law in Texas that protects children from gender modification procedures, SB 14, has been legally challenged as well and that lawsuit currently awaits a final decision from the Texas Supreme Court. If the U.S. Supreme Court upholds the 6th Circuit ruling in Skrimetti, then there will be a federal precedent that laws across the United States protecting children from sex-change operations are constitutional.

In the midst of the lawsuits, Texas Children’s Hospital (TCH) is being investigated by Texas Attorney General Ken Paxton due to potential medicaid fraud thanks to whistleblowers Dr. Eithan Haim and nurse Vanessa Sivadge who have come forward with information revealing child gender modification procedures taking place at the hospital and false claims being reported to Medicaid to protect the practice of child gender modification since Texas law SB 14 passed banning these treatments on minors. An article by the Dallas Express reveals, “This allegedly included claims that young female patients had testosterone deficiencies and young male patients had estrogen deficiencies.”
