Breaking! SCOTUS Hears Oral Arguments Today in Biden’s EMTALA attack on Unborn Babies

Washington D.C. — April 24, 2024: Today, the U.S. Supreme Court heard oral arguments in Idaho v. United States, the case on Biden’s HHS memo reinterpreting the Emergency Medical Treatment and Labor Act of 1986 (EMTALA) to require ER doctors to perform abortions. After Roe v. Wade was overturned, the Biden Administration sued the State of Idaho on the claim that EMTALA overrides their state law and mandates that emergency room doctors perform abortions, killing the unborn. 

Texas has also defended its pro-life law, the Human Life Protection Act, against an EMTALA challenge brought by doctors. The 5th Circuit Court of Appeals found in that case that EMTALA does not preempt Texas law.

Jonathan Covey, Director of Policy for Texas Values released the following statement:

“The Biden Administration’s attack on pro-life laws using EMTALA is a PR stunt to spread abortion lobby misinformation, not a valid legal strategy. Federal administrative agencies cannot illegally override legitimate state laws designed to protect women and the unborn.”
