Breaking: TX 10 Commandments Law Court Hearing Today!!

San Antonio, TX – August 15, 2025: Today, in San Antonio, Texas, a U.S. District Court in the Western District of Texas will hear a case filed by the American Civil Liberties Union (ACLU) and other outside legal organizations in an attempt to challenge the constitutionality of Senate Bill 10, the Texas Ten Commandments Law signed by Governor Abbott. SB 10 requires every public classroom in Texas to display a copy of the Ten Commandments. Texas Values has filed a legal response to the lawsuit and has asked the court to deny the ACLU’s request. You can find a copy of the Texas Values legal response with the court here.

The ACLU has cited to Texas Values’ work on this issue in the evidence they plan to present to the court in their court Exhibits.

Plaintiffs in the ACLU lawsuit and others largely base their argument on the legal standard from the Lemon v. Kurtzman case from 1971, as a legal standard called the “Lemon Test” that was recently struck down by the U. S. Supreme Court in the Kennedy v. Bremerton I.S.D. religious freedom case from 2022. In the Kennedy case, high school football coach Joe Kennedy was fired for praying on the fifty yard line of the field after each football game. Coach Kennedy won his case at the Supreme Court and the high court also struck down the “Lemon Test” in his case.

Jonathan Saenz, President & Attorney for Texas Values will be on the ground during the court hearing. Mr. Saenz has been a licensed attorney in Texas for over 20 years and is arguably the most well-known and accomplished state-based lawyer and policy advocate on the religious freedom issue in Texas and helped shaped the language and arguments in favor of the new law at the Texas Capitol in 2025. Mr. Saenz will be available for comments before and after the court hearing.

Mr. Saenz released the following statement:

“The ACLU and their New York lawyers they brought to Texas for this frivolous lawsuit and weak attempt to rewrite history are going to find out real fast that in Texas, you don’t mess with the Ten Commandments and religious freedom. As a Texas lawyer, I am one of many, along with Governor Greg Abbott and our Texas Attorney General’s office, who are ready to protect our Texas Ten Commandments law in every school district and classroom in the Lone Star State. Mark my word, we will win this battle of biblical proportions.“

The hearing will take place at the United States Courthouse, Courtroom G, 262 W. Nueva St. in San Antonio, Texas 78207 at 10:00 am today.

Texas Values was one of the leading organizations working for the passage of SB 10, the Texas Ten Commandments legislation, and stands shoulder to shoulder with partner organizations such as First Liberty Institute prepared to defend SB 10 against any court challenges brought against it.
