Texas Supreme Court Upholds Pre-Roe Abortion Bans

Austin, TX – July 2, 2022

On Friday evening, the Supreme Court of Texas ordered that a set of 1925 pre-Roe statutes banning abortion, that had been suspended when Roe v. Wade was decided in 1973, could be enforced immediately.

This order came in response to an earlier motion filed by Attorney General Ken Paxton asking the state’s highest court to block a temporary restraining order (TRO) issued by a Harris County district court earlier this week. The district court had imposed previously issued the TRO at the request of abortion clinics who argued that the laws were outdated and repealed by implication.

Director of Policy for Texas Values, Jonathan Covey, released the following statement:
“We are grateful the Texas Supreme Court blocked this temporary restraining order that clinics were using as an excuse to kill pre-born babies. No matter how hard abortionists try to perpetuate murder, we know that life is a human right.”
