SB 723 ensures that Texas laws on marriage are consistent with court precedent and the Texas Constitution (one man, one woman). Last session, an amendment was tacked onto a bill that caused inconsistency in how gender is determined for marriage licenses. SB 723 closes this loophole by affirming that one’s gender on a birth certificate is one’s gender on a marriage license, regardless of alleged sex change results.
Gay, lesbian, bisexual, and transgender advocates oppose SB 723. These groups also want to repeal our constitutional amendment that defines marriage as one man, one woman. Without SB 723, there will be confusion and inconsistency that will be used to undermine our marriage laws.
